Summary

The Toxic Chemical Substances Hazard Prevention and Response Plan Regulations is promulgated pursuant to Article 10 of the Toxic Chemical Substances Control Act (Taiwan TCSCA). There are two conditions that require the submission of the hazard prevention and response plan.

Compared with the 2007 version, concerning the emergencies occurred during the transportation of Class 1, 2 and 3 toxic chemical that will hazard the environment and human health, Article 2 was revised supplemented the Condition 2 mentioned below.

Condition 1

The handlers of Class 1, 2 and 3 toxic chemical substances, except for those engaged in export or disposal (apply for registration by batch), shall submit hazard prevention and response plans concerning the toxic chemical substance before applying for a permit (manufacture or import) or registration (usage or storage).

As for the approval applied when the total quantity handled is lower than the large-scale handling standard official released, the submission of hazard prevention and response plans are exempted. The competent authority shall provide hazard prevention and response plans of the Class 3 toxic chemical substance to the public for reference within 15 days of approval. 

The items included in the hazard prevention and response plan have been supplemented, including the two degree zone transverse mercator projection (TM2) of the main gateways, exit and entrance of the storage sites and the usage site; and the hazard modeling analysis for Class 3 toxic chemical substances. These new requirements took effect on July 1, 2011.

Condition 2

Compared with the 2007 version, concerning the emergencies occurred during the transportation of Class 1, 2 and 3 toxic chemical that will hazard the environment and human health, Article 2 was revised and the Condition 2 was supplemented. In accordance with the new condition, Article 4 was added to stipulate the items included in the hazard prevention and response plan for transportation specifically. The new terms concerning the Condition 2 took effect on July 1, 2011.

The owners of Class 1, 2 and 3 toxic chemical substances who carry out transportation on their own or entrust others to transport, if the following transportation conditions encountered, shall submit a transportation hazard prevention and response plan to the corresponding competent authority of municipality, county or city level at the location where the transportation commences. The transportation hazard and response plan is a must in the application for the delivery manifest prior to the transportation of these substances.

The transportation conditions mentioned above correspond to the conditions stipulated in Article 2 of Toxic chemical Substances Transportation Management Regulations.

  • The net weight of toxic chemical substances transported by sea or land exceed the following quantities:

(1) Gas: 50 kg

(2) Liquid: 100 kg

(3) Solid: 200 kg

The “gas”, “liquid” and “solid” refer to toxic chemical substances under normal temperature and pressures

  • The transportation by air under government approval

  • Importing or exporting the toxic chemical substances
