K-REACH Pre-registration: Concise Overview of Critical Checkpoints

The Act on Registration, Evaluation and etc. of Chemicals (a.k.a “K-REACH”) has been revised and will come into effect on 1 Jan 2019. It should be noted that pre-registration before 30 Jun 2019 is necessary to be eligible for the phase-in registration grace period. In addition, it will streamline mandatory joint registration of identical substances.

The Japanese “Act on the Evaluation of Chemical Substances and Regulation of Their Manufacture, etc.” is better known as the “Chemical Substance Control Law” (CSCL). Since its enactment in 1973, it has imposed strict pre-market evaluation of chemical substances to prevent environmental pollution and control chemical risks to human health, plants and animals. It has been amended 3 times in 1986, 2003 and 2009. Full implementation of amended CSCL started from April 1, 2011.

K-REACH Legislation Further Amended: Law No. 15844

New amendments were passed and incorporated into the revised K-REACH as Law No. 15844 on 16 Oct 2018. New K-REACH legislation will come into effect on 1 Jan 2019. Corresponding K-REACH secondary rules are currently undergoing public consultation which will end on 26 Nov 2018.

China’s chemical industry is the nation’s 3rd largest contributor to economic growth. Approximately 25% of the products/commodities subject to increased US tariffs are produced by China’s chemical industry. To offset the impact of US tariffs, MEE will throttle back on environmental protection goals and reduce requirements for PM2.5 concentration and the number of days of heavy pollution permitted. MEE will no longer demand an arbitrary and mandatory cut in production rates but will instead allow provincial/local governments to tailor an individualized scheme.
