China's Decree 591: Overarching Legislation for Hazardous Chemicals

On 1 December 2011, the revised Regulation on the Control over Safety of Hazardous Chemicals, also called Decree 591, came into force. The key piece of legislation on management of hazardous chemicals, it regulates them through the entire supply chain, from manufacture and importation to distribution and storage, transportation and use.

China Hazardous Chemicals Regulations - Decree 591

The first law that regulated the safe management of dangerous chemicals in China came into being in 1987 when the so-called Regulations of Chemical Dangerous Goods Safety Management took effect on 2 February. After 15 years’ constant legal improvement, the State Economic and Trade Commission published on 2nd March 2002 a new regulation Decree No. 344 based on the 1987 law. However, due to the reform of governmental institutions and rapid development of hazardous chemical industry, Decree No. 344 began falling short of efficently regulating the hazardous chemicals industry.

In order to enhance the safety of human health and the environment, the GHS (Globally Harmonized System of Classification and Labeling of chemicals) was issued as a recommendation from the United Nations in 2003. The purpose of implementing GHS is for the provision of a recognized framework for countries without an existing system, to reduce the need for testing and evaluation of chemicals and to facilitate the international trade in chemicals whose hazards have been properly assessed and identified.
