Vietnam to Impose New Requirements for Industrial Chemical-Related Activities

On October 27, 2022, Vietnam’s Ministry of Industry and Trade promulgated the Circular No.17/2022/TT-BCT to amend and supplement a number of articles of Circular No.32/2017/TT-BCT, a circular that provides guidelines for implementation regulations of Law on Chemicals. The Circular will take effect from December 22, 2022.

On October 18, 2022, Vietnam’s Government issued Decree 82/2022/ND-CP to introduce amendments to the existing Decree 113/2017/ND-CP, one of many decrees supporting the implementation of the Law on Chemicals. The new Decree is set to take effect on December 22, 2022.

On October 12, 2022, Vietnam’s Ministry of Industry and Trade (MOIT) released a proposal to revise the Law on Chemicals (06/2007/QH12)*. The draft revision is expected to be finalized and submitted for comments at the 8th Session of the 15th National Assembly in October, 2024 and approved at the 9th session in May, 2025.

Vietnam to Revise Circular No. 32/2017/TT-BCT for Implementation of Law on Chemicals

On April 28, 2022, Vietnam Ministry of Industry and Trade (MOIT) issued draft amendments to the Circular No. 32/2017/TT-BCT which was effective on December 28, 2017 as implementation guidelines to the Decree No. 113/2017 and the Law on Chemicals. Comments are welcome before June 26, 2022.
Vietnam Implements New ODSs Regulations under Decree No. 06/2022/ND-CP of LEP

On January 7, 2022, the Government of Vietnam published Decree No. 06/2022/ND-CP Regulations on Reduction of Greenhouse Gas Emissions and Protection of the Ozone Layer, detailing provisions of the Law on Environmental Protection 2020. On the same day, the Ministry of Natural Resources and Environment (MONRE) published Circular No. 01/2022/TT-BTNMT Detailing the Implementation of A Number of Articles of the Law on Environmental Protection in Response to Climate Change, which provides the list of controlled ozone-depleting substances and guidance for their management. Both of them took effect immediately.

On Jan 21, 2022, Vietnam Ministry of Science and Technology published the Draft Circular Stipulating the Display of Some Mandatory Labeling Contents by Electronic Method for public comments until March 22, 2022. It is expected to be implemented in June, 2022.

On January 10, 2022, Vietnam published Decree No. 08/2022/ND-CP Detailing a Number of Articles of the Law on Environmental Protection and Circular No. 02/2022/TT-BTNMT on Implementation Rules for a Number of Articles of the Law on Environmental Protection. Both of them took effect on January 10, 2022.
