On April 29, 2020, China’s MEE published the amendments of the Measures for the Environmental Management of New Chemical Substances (MEP Order 7 of 2010). It is renamed as the Measures for the Environmental Management Registration of New Chemical Substances (MEE Order 12 of 2020), which will come into force on January 1, 2021.

The draft will replace the original MEP Order No.7 when it comes into force.

The draft Regulation on Chemical Substance Environmental Risk Assessment and Control was issued on 8 Jan, with the ambition to comprehensively manage chemicals, covering both new and existing chemicals in China. The MEE will also establish technical guidance and a database for environmental risk assessment of chemical substances to support the regulation.

Revised Data Requirements and Exemption Conditions for China New Chemical Notification

The amendments on data requirements in China's New Substance Notification Guidance were published on Aug 28th 2017 as an individual announcement (MEP Announcement No.42 of 2017), rather than being published as part of the full document of the revised Guidance. The amendments will take effect from Oct 15th 2017. Compared to the current version issued in 2010 (e-translation available on e-book store), updates have been highlighted in yellow in this translation, which will facilitate effective planning and utilization of the test programs according to the new requirements.

On 8 Mar 2016, the Ministry of Environmental Protection of China notified the Committee on Technical Barriers to Trade under World Trade Organization (WTO) a draft guidance on China new chemical notification (G/TBT/N/CHN/1170). According to the WTO notification, the Guidance is proposed to enter into force on 1 Nov 2016. Compared to the previous draft issued on 25 Jun 2015 (e-translation available on e-book store), updates have been highlighted in yellow in this translation.

Jun 25, 2015 saw the official release of the draft of the revised China New Chemical Substance Notification Guidance after more than 1 year of deliberation. The draft is now open for public consultation until 31 July, 2015.Primary changes in the revised draft focus on the applicable scope, management policy, data requirements and waiving, notification procedures, requirements of risk assessment report and post-notification requirements. Compared to the current guidance, when promulgated the new one will impose a more comprehensive management on new chemical substance notification in China.

They will also face escalated compliance urgency on GHS hazard classification, labeling, SDS making/updating and more visible regulatory concerns like hazard identification and risk control measures.
