Decree 82/2022/ND-CP: Amending Decree 113/2017/ND-CP guiding Law on Chemicals

On October 18, 2022, Vietnam’s Government issued Decree 82/2022/ND-CP to introduce amendments to the existing Decree 113/2017/ND-CP, one of many decrees supporting the implementation of the Law on Chemicals. The new Decree is set to take effect on December 22, 2022.

According to Circular 07/2013/TT-BCT issued by the Vietnamese Ministry of Industry and Trade (MOIT) on 22 Apr 2013, enterprises that use the listed 117 hazardous chemicals in producing their products are subject to compulsory registration and reporting obligations from 1 Jan 2014.The 117 chemicals listed in the Appendix 1 of the Circular 07/2013/TT-BCT are incorporated into the current list. Please note that slight modification has been made on the original Appendix 1 as the listed chemicals with more than one CAS numbers have been categorized to be different entries in the current list, therefore 131 entries in total were incorporated in the current list.

The regulation was promulgated on Nov 9, 2009 by the Prime Minister and scheduled to take effect as of Dec 31, 2009. The regulation specifies packaging and labeling requirements, responsibilities of the consignor & carrier, the qualification criteria to grant permits for road transport of dangerous goods by motor vehicles, etc..For radioactive materials and industrial explosive materials, they need to comply with this regulation and other legislations specific for the materials (i.e. Law on Atomic Energy, Government's Decree No. 39/2009/ND-CP respectively).

The Law on Chemicals is the overarching regulation in Vietnam that regulates the activities related to chemicals and chemical industry. Since the publication of the Law in 2007, Vietnam government has been promulgating new implementation guidelines and revisions to the Law in order to align the regulatory requirements with latest developments and demands in the chemical industry, among which the Decree No.113/2017 is the most important one.To further assist the implementation of the Decree No. 113/2017, MOIT published a ministerial circular named Circular No. 32/2017/TT-BCT in Dec 2017 and specified a number of articles of the Law on Chemicals and the Decree No. 113/2017. The Circular took effect on Dec 28th, 2017.
