Taiwan: Toxic and Concerned Chemical Substances Control Act Enforcement Rules

On Sep 3rd, 2019, the revision to Taiwan’s Toxic Chemical Substances Control Act Enforcement Rules was approved with the changes scheduled to take effect on Jan 16th, 2020. Taiwan EPA aligned the enforcement rules with the new Toxic and Concerned Chemical Substances Control Act(TCCSCA, promulgated in Jan 2019, previously known as Taiwan TCSCA), and renamed it as the Toxic and Concerned Chemical Substances Control Act Enforcement Rules. The Enforcement Rules was firstly published in 1989 and has been updated six times since then. It functions as one of the most important supporting documents to the TCCSCA. The revised Enforcement Rules will come into effect on Jan 16th, 2020, the same implementation date as Taiwan TCCSCA.

Taiwan: Toxic and Concerned Chemical Substances Control Act

TCSCA is the most important chemical control law in Taiwan. It has undergone six amendments since its first promulgation in 1986. The last amendment was made in 2013 and implemented the core principle of chemical registration. However, after promulgation a number of high profile chemical accidents occurred, prompting the government to revise the Act again with a view to better management of chemicals throughout the supply chain. The revised Act is renamed the Toxic and Chemical Substances of Concern Control Act, which entails a broader control over chemicals.

The Toxic Chemical Substances Hazard Prevention and Response Plan Regulations is promulgated pursuant to Article 10 of the Toxic Chemical Substances Control Act (Taiwan TCSCA). There are two conditions that require the submission of the hazard prevention and response plan.Compared with the 2007 version, concerning the emergencies occurred during the transportation of Class 1, 2 and 3 toxic chemical that will hazard the environment and human health, Article 2 was revised supplemented the Condition 2 mentioned below.

Compared with the previous version, the main amendments are as below:The name of the regulation, Taiwan’s Toxic Chemical Substances Labeling and Materials Safety Data Sheet Regulations, is renamed as “Toxic Chemical Substances Labeling and Safety Data Sheet Regulations”To align with the Globally Harmonized System for Classification and Labelling of Chemicals (GHS), the name of “Material Safety Data Sheet” is changed to “Safety Data Sheet”.Since the Chinese National Standards (CNS) 15030 on Classification and Labeling of Chemicals has specified the classification and labeling requirements, containers and packaging of toxic chemical substances should comply with CNS 15030 serial national standards instead of the previous Appendix 1. As for the handling sites and facilities of toxic chemical substances, presenting hazard information in clearly visible locations should also refer to CNS 15030 serial national standards. The Appendix 1 of the previous Regulation is eliminated.

The “Regulation of New and Existing Chemical Substances Registration” entered into force on 11 Dec 2014 setting out specific provisions under Taiwan TCSCA for chemical substances manufactured or imported in Taiwan. The newly released Guidance relates to this regulation, aiming to guide potential registrants in complying with their obligations.
