Proposition 65 became law in November 1986. The official name of Proposition 65 is the Safe Drinking Water and Toxic Enforcement Act of 1986. Its goals are to protect drinking water sources from toxic substances that cause cancer and birth defects and to reduce or eliminate exposures to those chemicals. Proposition 65 requires California to publish a list of chemicals known to cause cancer, birth defects or other reproductive harm. The California Environmental Protection Agency’s Office of Environmental Health Hazard Assessment (OEHHA) is the lead agency for the implementation of Proposition 65. OEHHA has selected perfluorodecanoic acid (PFDA) and its salts, perfluorohexanesulfonic acid (PFHxS) and its salts, and perfluoroundecanoic acid (PFUnDA) and its salts for the DARTIC’s review for possible listing under Proposition 65.
