The Ordinance, which took effect since 19 Jul, 2013, was formulated to protect consumers from unfair practices resulting from false trade descriptions, misleading or incomplete information, false marks and misstatements for goods or services.
In comparison to the pre-amending Trade Description Ordinance, the current Ordinance:
Has an extended coverage by adding “services” into its surveillance scope
Create new offences against “unfair trade practices” such as misleading price tag
Strengthens the enforcement powers of the authorities; and
Support the aggrieved consumers to seek compensation
The measures is formulated according to the “Law of the People’s Republic of China on Promoting Clean Production”(President Order 72) and “Law of the People’s Republic of China on the Prevention and Control of Environmental Pollution by Solid Wastes”(President Order 31).
