Thailand - Notification of MOI Subject: Hazard Classification and Communication System of Hazardous Substances B.E. 2555 (2012)

Thailand adopted UN GHS with the release of the MOI Notification B.E. 2555 (2012). In consistent with the 3rd revision UN GHS, Thailand GHS also adopts 28 hazard categories. The implementation of GHS is a two-step action, with GHS taking effect on Mar 13, 2013 for single substances and Mar 13, 2017 for mixtures. DIW is the first authority to enforce GHS. Currently, only substances listed in the Annex 5 of MOI Notification B.E. 2556 is subject to the GHS-related obligations. It is expected that FDA will announce GHS soon, followed by other government authorities.In consistence with UN GHS 3rd revision, Thailand GHS adopted 28 hazard classes categories into physical hazards (16), health hazards (10) and environmental hazards (2).

The Industry Code of Practice (ICOP) on Chemicals Classification and Hazard Communication 2013 is promulgated under Section 37 of Occupational Safety and Health Act 1994 (OSHA 1994) as a supportive technical guidance to implement the CLASS Regulations 2013. (Hereinafter referred as the “CLASS ICOP”)Generally speaking, the CLASS ICOP provides guidance on chemical classification and hazard communication, as well as a list of chemical substances that have been officially classified. CLASS ICOP adopts method and classification criteria in the 3rd revised edition of the UN GHS.

On Nov 9th, Taiwan's Ministry of Labor (MoL) published the amendments of the Regulation of Labeling and Hazard Communication of Hazardous Chemicals (危害性化學品標示及通識規則). The updated provisions became effective immediately. However, the updated requirements of Attachment 4 (Content and Template for Safety Data Sheet) will take effect from Jan 1st, 2020.The amendments include Article 4, Article 5, Article 13, Article 18, Article 18-1, Article 23, Attachment 1 and Attachment 4.

South Korea GHS: Standards for Classification and Labeling of Chemical Substance and Material Safety Data Sheet (MoEL Public Notice No. 2016-19)

On April 6, Korean Ministry of Employment and Labor (MOEL) published the revised Standards for Classification and Labeling of Chemical Substances and Material Safety Data Sheet by Public Notice No.2016-19, which entered into force immediately.By adopting the hazard category “hazardous to the ozone layer” and revising some of the hazard statements and precautionary statements, the new standards update the 2013 standards (MOEL Public Notice No.2013-37) to align with UN GHS Rev.4 (2011). In accordance with the transitional provision in Public Notice No.2016-19, classification, labeling and SDS preparation should be conducted in accordance with Annex 1, 2 and 4 of Public Notice No.2013-37 are acceptable until April 6, 2017.
