The Industry Code of Practice (ICOP) on Chemicals Classification and Hazard Communication 2013 is promulgated under Section 37 of Occupational Safety and Health Act 1994 (OSHA 1994) as a supportive technical guidance to implement the CLASS Regulations 2013. (Hereinafter referred as the “CLASS ICOP”)Generally speaking, the CLASS ICOP provides guidance on chemical classification and hazard communication, as well as a list of chemical substances that have been officially classified. CLASS ICOP adopts method and classification criteria in the 3rd revised edition of the UN GHS.

Taiwan: Occupational Safety and Health Act

Taiwan's Occupational Safety and Health Act (previously Labor Safety and Health Act) was promulgated by the Ministry of Labor(MoL) on 3 July 2013 and took effect on 3 July 2014. This Act is enacted to protect workers’ safety and health and to prevent occupational accidents. Work assigned to laborers by the employers shall be within a reasonable and feasible scope, with necessary preventative equipment or measures taken to prevent laborers from being involved in occupational accidents.

Regulations of New and Existing Chemical Substances Registration

The Regulation of New and Existing Chemical Substances Registration was promulgated on 5 Dec 2014 and came into effect on the 11 Dec 2014. Taiwan EPA drafted revisions to the regulation in Sep 2017 and issued an updated revision proposal based on the feedbacks collected from the industry on 29 Mar 2018. The long-awaited amendments of the regulation was finalized and promulgated on Mar 11th, 2019 and took effect immediately. However, the new requirements for annual reporting of registered substances and the standard registration of 106 existing substances will be implemented from 2020.

Taiwan: Toxic and Concerned Chemical Substances Control Act Enforcement Rules

On Sep 3rd, 2019, the revision to Taiwan’s Toxic Chemical Substances Control Act Enforcement Rules was approved with the changes scheduled to take effect on Jan 16th, 2020. Taiwan EPA aligned the enforcement rules with the new Toxic and Concerned Chemical Substances Control Act(TCCSCA, promulgated in Jan 2019, previously known as Taiwan TCSCA), and renamed it as the Toxic and Concerned Chemical Substances Control Act Enforcement Rules. The Enforcement Rules was firstly published in 1989 and has been updated six times since then. It functions as one of the most important supporting documents to the TCCSCA. The revised Enforcement Rules will come into effect on Jan 16th, 2020, the same implementation date as Taiwan TCCSCA.

Taiwan: Toxic and Concerned Chemical Substances Control Act

TCSCA is the most important chemical control law in Taiwan. It has undergone six amendments since its first promulgation in 1986. The last amendment was made in 2013 and implemented the core principle of chemical registration. However, after promulgation a number of high profile chemical accidents occurred, prompting the government to revise the Act again with a view to better management of chemicals throughout the supply chain. The revised Act is renamed the Toxic and Chemical Substances of Concern Control Act, which entails a broader control over chemicals.
