China SAWS National Investigation on Occupational Disease and Hazards

According to a recent notice issued by the State Administration of Work Safety (SAWS), China will carry out a series of national investigations on occupational disease and hazards. The investigations will begin in April and end in August, 2015. The results will be publicized and measures and conclusions drawn up thereafter. The legal basis of the enforcement is the Occupational Disease Prevention and Control Law and the 2009-2015 National Plan on the Prevention and Control of Occupational Diseases. 

Every provincial administration of work safety will nominate 4 cities and/or prefecture-level cities, from which SAWS will designate two as investigational targets. The local authority will then draft a candidate list which should include at least of 300 employers. A heavy emphasis will be placed on the construction and metallurgical industries. SAWS will then pick 50 employers and conduct a profile review and a finally another 5 to conduct a spot check on. 

a) Companies subject to profile review should provide the following information:

  1. Notification form of occupational diseases and hazards;

  2. List of persons in harge

  3. List of occupational health management personnel, employment certificates, relevant training certificates issued by work safety administrations or other accredited institutions, or other qualification proofs;

  4. List of employees who’re vulnerable to occupational diseases and hazards, records of occupational health training, or proofs of other related activities in 2014;

  5. Project files including new construction, reconstruction, expansion, technical reform and application of new technology in the past 3 years; materials of pre-assessment of occupational health risks, preliminary design, assessment on control effect, etc., and archive documents or issuances of the local administration of work safety;

  6. Inspection report of occupational disease and hazard factors of 2014

  7. Records of the enforcement on occupational disease and hazard prevention and control receive by the company in 2014

  8. Occupational health check summary reports of the past 3 years, health check results of vulnerable employees;

  9. Labor contracts of the past 2 years

  10. Occupational disease and hazard labels, specifications, warnings and marks (see CL news on 2014-11-28)

b) Companies subject to spot check should provide:

1~7 the same as in part a);

  1. Inventory of occupational disease and hazard facts, including names of vulnerable employees, workshops, job position/title, information on exposure to the occupational disease and hazard factors, etc.;

  2. Occupational health check reports from the past 3 years;

  3. Labor contracts

  4. Other materials required by SAWS
