Reminder: Approaching Deadline for Anti-dumping Measures against Acrylates Imported from Malaysia, Singapore and Indonesia

On October 8th 2013, China Ministry of Commerce (MOFCOM) issued Notice No.64, stating April 9th 2014 is the due date of the anti-dumping duties imposed upon acrylates imported from Malaysia, Singapore and Indonesia.

The anti-dumping measures started from April 9th 2009. As stipulated in Article 48, Anti-dumping Regulations of the People’s Republic of China, “The term for the levy of anti-dumping duties and fulfillment of price undertakings should not exceed 5 years”. However, the term may be extended if the termination is considered to result in “continuation or recurrence of dumping and injury”.

Therefore, if any review application from China’s domestic industries is accepted by MOFCOM 60 days before the deadline, the extension of anti-dumping duty term will be subject to the result of review investigations, which could last as long as 12 months.
