SAWS Spell out Implementing Suggestion of HC Operation Permit

With the effective date of the “Measures for the Administration of Hazardous Chemical Operation Permit” (SAWS Order 55 of 2012)  started on September 1, 2012, ambiguities has arisen from the subsidiary work safety authorities and subject companies. The concerned questions and suggestion have been explicitly explained by the SAWS in an official letter, the SAWS Missive 179 of 2012 on October 17th, 2012 for public reference.

Items such the scope, competent authorities, application materials, renewal terms, modification were defined in the letter. Major implementing suggestions were summarized below:

  • The storage-equipped gas station engaged the operation of petroleum products which are HC shall make safety evaluation of its operation condition;

  • The district and county-level work safety authority from a municipality will have the same jurisdiction as a city-level work safety authority, that is, a district/county work safety authority can review and issue the HC operation permit to the operating companies of highly toxic chemical, the explosive chemicals, the gas stations, storage companies of HCs, city subsidiaries of the state-owned enterprise engaged in the operation of HCs, the storage-equipped HC operating companies other than highly toxic chemical and explosive chemicals. If the HC operating company who stores the HCs but does not constitute major hazard installations, it shall apply for operation permit from the city or county authority. The HC company shall apply the application to the local work safety authority with the same jurisdiction where it has registered for industry & commerce registration;

  • The permit applying companies shall submit copies of professional training certificates of the business staff. In addition to the qualification certificates of major principals, executives, safe production management personnel and special operation personnel, new employees of the companies shall be trained and educated of safety operating, emergency handling on the HCs and copies of the training certificates shall be submitted by the companies;

  • If the permitted companies altered its operation pattern among only-storage of HCs, HC operations while equipped with the storage device, and HC operating without the storage device, the companies shall re-apply the operation permit;

  • The operation permit is 3 years valid and an application for extension or renewal shall be submitted to the permit-issuing body. If no denial or other negative decision has been made within the deadlines, a case of automatically extension could be considered.
