Turkey SDS: Regulators Issue Challenging New Regulation

On Dec 15th 2014, Turkey published the Regulation on Safety Data Sheets for Hazardous Substances and Mixtures, which went into force immediately. The new regulation replaces the former SDS regulation 27092.

The former Turkish SDS regulation has been a subject of controversy due to its non-conformity with the latest GHS classification and labelling regulations and was a source of much trouble for industry when authoring SDS compliant with Turkish regulations. With the publication of the new SDS regulation, Turkey’s SDS format is almost aligned with EU 453/2010, although there are still some minor differences between the two due to the absence of a REACH-like regulation in Turkey.

There are some notable key points in the new regulation:

  • The regulation will become obligatory for hazardous substances from Jun 1st, 2015, and for hazardous mixtures from Jun 1st, 2016.

  • The SDS should be in Turkish and a soft copy of the SDS should be submitted to the MoEU.

  • The new Turkish SDS format includes 16 sections and 48 subsections.

  • SDS authors with a certificate issued under the old regulatory system can still author SDS in accordance with the former regulation. However, they cannot start authoring SDS under new regulatory requirements until they get their certificate renewed by passing an examination.

The new regulation poses huge difficulties for industry because they have less than half a year to comply with it for hazardous substances. There is also widespread doubt as to whether or not certification bodies will be able to cope with demand for training and examination services.
