Case Study: Exemptions Under China REACH

Background: An EU-based Client provides raw materials (less than 1 tonne per year) to importers in China. They have three substances not listed on the Inventory of Existing Chemical Substances in China (IECSC) 2010 and requested notification services from us. Since the manufacturing process of these substances involves only a physical process, the client believes the substances extracted from these naturally occurring substances should qualify for exemption rules.

GLP in China: REACH24H Experts Offer Advice and Inferences

Good Lab Practice (GLP) was first drawn up as an internationally agreed guideline for the non-clinical testing of pharmaceuticals and chemicals. Companies preparing Risk Assessment report while complying with China Chemical Regulations are more often than not, faced with the option to choose between data generated with the non-GLP and GLP laboratories. Meanwhile, the promotion of GLP in China Regulatory compliance sector has been observed through its incorporation into some of the key Regulation recently released, such as "Measures on the Environmental Management of New Chemical Substances". Since a major revision of China's Measures on Environment Management of New Chemical Substances came into force last October, companies wishing to manufacture or import a new substance in China have been obliged to first notify new chemical substances - those not listed on the Inventory of Existing Chemical Substances in China (IECSC) - to the Chemical Registration Centre (CRC). Under the regime, regular notifications for substances must include a risk assessment report.

Chemical Regulations in China: Industry and Stakeholders Obligations

State Council of China introduced the revised Regulation on Safety Control of Dangerous Chemicals in 2-Mar-2011, which would formally enter into force in 1-Dec-20111, and under this newly reformed chemical regulation, which function as the umbrella law, different Ministries and Administration will be involved into implementation and various administrative provisions promulgated accordingly as well, and then the resulting regulatory challenges to chemical industry were concerned and highlighted recently. Within this article, the primary regulatory obligations and related challenges were reviewed.

The chemical regulatory framework in China has become increasingly influenced by global chemical regulations, in particular the European and US models. Since China became a member of the WTO in 2001, the government has been committed to revising China’s chemical regulations. The previous legislation concerning the management of new chemical substances in China was amended on October 15th 2010, through the enactment of the "Measures for the Environmental Management of New Chemical Substances" (the "Measures") by China’s Ministry of Environmental Protection (MEP). This regulation is similar to EU REACH and adopts several of the same principles and concepts of the European regulation, and thus has been dubbed "China REACH". However, China REACH is a general term for legislation covering hazardous, toxic and new chemical substances (Figure 1), while the Measures specifically regulate new chemical substances.
