Japan Chemical Substances Control Law (CSCL) requires the chemical industry to submit annual notification to the Ministry of Economic, Trade and Industry (METI) on the volume of “general chemical substances”, “priority assessment chemical substances”, “monitoring chemical substances “and “class II specified chemical substances” manufactured, imported, etc. The data is collected and further analyzed by the government to monitor and prevent environmental pollution.
To fulfill annual notification obligations, Japanese chemical manufacturers and importers should fill out Form 9 as attached in METI Ordinance No.40 of 1974 (last revised by METI Ordinance No. 14 of 2005, a.k.a. METI-related Ordinance for Enforcement of CSCL), by submitting either paper materials or optical discs (or any applicable electronic data processing system).
The current June 30th deadline for compliance with annual notification obligations places a considerable burden on the industry and there have been widespread calls for extension of the deadline. Industry is arguing that the current deadlines are severely overtaxing their capacity to produce and compile the required data. There have also been calls for cancellation of the requirement to submit electronic signature and electronic certificate for notification of “monitoring chemical substances” and “class II specified chemical substances”.
In response to these appeals the Chemical Safety Office of Chemical Management Division under METI recently proposed an adjustment to the following CSCL implementation rules:
The submission deadline for annual notification via electronic formats according to Clause 2 , Article 9-2; Clause 2, Article 9-3; Clause 2, Article 10 and Clause 2, Article 15 of METI-related Ordinance for Enforcement of CSCL will be extended to July 31st.
Annual notification of “Monitoring Chemical Substances” and “Class II Specified Chemical Substances” via electronic formats no longer require electronic signature and certificate.
The final decision will be published around this Mar after the public consultation from Jan 22nd to Feb 20th.
