MEP Establishes Timeline for Annual Import and Export Permits of Ozone-depleting Substances

From March 1st 2014 China will implement the newly issued Measures for Import and Export Control of Ozone-depleting Substances (MEP Order 26). Meanwhile, the previous Measures (MEP Notice No.278 of 1999) and Administrative Specifications (MEP Notice No.85 of 2000) will be revoked.

MEP Order 26 was formulated in accordance with Regulations on the Control over Ozone-depleting Substances (State Council Decree No. 573), to enhance China’s management of the concerned substances and to fulfill China’s obligations under the Montreal Protocol and its amendments.

The regulatory scope of MEP Order 26 includes all forms of importing and exporting of substances in the “List of Ozone-depleting Substances Subject to Import and Export Control in China”, except as expressly required by other provisions (e.g. donation, sample goods, advertising items and sales return shipment). The List is managed by MEP, Ministry of Commerce (MOFCOM) and the General Administration of Customs (GAC).

MEP Order 26 sets the timeline for quota management of ODS import and export. The authorities will release next year’s quota by December 20th. Importers/exporters should apply before October 31for the import/export quota of the following year. Decisions will be made by competent ODS authority within 20 workdays and before December 20, on whether to sign and issue the Approval Sheet or not. The Approval Sheet is used to apply for the Import and Export Permit of ODSs from provincial administrations of commerce, and it expires in 90 days or at the end of the year. The Permit can only be used once for customs clearance.

In case that the actual import/export amount is less than the quota, the importer/exporter should notify the ODS authority within 20 workdays after all customs clearance formalities are completed.

If the company decides to cancel the import/export after acquiring an import/export permit, the importer/exporter should notify the ODS authority within 20 workdays after the permit expires.

Companies who have successfully applied for the annual quotas but cannot use all of them (including the two situations mentioned above) should report and return the excess quotas to the ODS authority before October 31st of the same year. Otherwise, their quotas of the next year may be reduced or revoked.

 Special note:
Import/export application of ODSs listed in the Inventory of Hazardous Chemicals should provide the certificate for environmental management of hazardous chemicals of Chinese user/producer, and use/operation/production permit of hazardous chemicals issued by China administrations of work safety.
