Thailand Requires Risk Management Measures for Certain Substances

On Jan 12th 2017, Thailand’s Ministry of Industry (MOI) announced that the industry had compliance duties  for some designated chemical substances. All the substances were added into Annex 4 and Annex 5 to the List of Hazardous Substances. They are regulated by the Food and Drug Administration (FDA) and the Department of Industrial Works (DIW). The substances were:

  • Substances regulated by FDA:

    • 1,1,2- trichloroethane used in dry cleaning and other specialist solvent applications

    • Methanol used in certain consumer products

    • Formaldehyde used in floor cleaning products

    • And organic solvent-based products used to touch-up car paint, as correction fluid, or as textile stain removers

  • Substances regulated by DIW:

    • Cresol or methyl phenols

    • And seven hydrofluorocarbons (HFC-245, -338mcc, -338mee, -356ffa, -1234yf, HFO-1234ze and HFO-1336mzz-Z)

These substanes were classified as Type 2 or Type 3. So the industry should apply for license and/or register for these substances.

The 1st version of Thailand’s Inventory of Existing Chemicals is expected to be published during the middle of 2017. Now DIW is working on the criteria for Substances of Very High Concerns (SVHCs) and compilation of a list of SVHCs. These chemical substances will be the first batch for which the industry will have to compile Chemical Risks Assessment (CRA) reports. It is expected that carcinogenic, mutagenic and substances toxic to the reproductive system (CMRs), the persistent bio-accumulative toxic substances (PBTs) and the very persistent and very bio-accumulative substances (vPvBs) will be included in the list.

The provisional implementation timeline for the CRA requirements on SVHCs is set as 2020 for substances over 1000 ton/year, 2022 for substances between 100 and 1000 ton/year, and 2025 for substances between 10 and 100 ton/year.
