Action Plan for New Pollutants Treatment (Draft)

On October 11, 2021, the Chinese Ministry of Ecology and Environment (MEE) issued the draft Action Plan for New Pollutants Treatment.The Plan outlines the general requirements, goals and six major measures for new pollutants treatment, as well as the first batch of new pollutants for priority management in the annex (including 28 types of chemicals). According to the Plan, a series of relevant regulations and standards are going to be formulated, revised or issued, providing with the timeline of the issuance of the supporting national standards and technical guidelines.

On October 11, 2021, the Chinese Ministry of Ecology and Environment (MEE) published a notice to seek public feedback on the draft Action Plan for New Pollutants Treatment (hereinafter referred to as the draft Plan). The draft Plan outlines the general requirements, goals and six major measures for new pollutants treatment, as well as the first batch of new pollutants for priority management in the annex. The first batch of new pollutants for priority management includes 28 types of chemicals. Notably, each type of chemical is provided with its own management measures, like prohibiting its production, processing, import, export, etc.

List of taxable pollutants subject to environmental protection tax

China's Law of Environmental Protection Tax was drafted in 2015 and passed by the Standing Committee of The National People's Congress of China in late 2016. The Law took effect on Jan 1st 2018 and ultimately replaced the emission fee system which has been in place for almost 40 years. Two appendices are attached with the Law, stipulating the scope, pollution equivalents and taxation standards applicable to various pollutants, including atmospheric pollutants, water pollutants, solid wastes and noises.
