On November 4, 2022, Taiwan's Environmental Protection Administration (EPA) published the amendments to the Regulation for the Labeling and Materials Safety Data Sheets for Toxic and Concerned Chemical Substances (hereinafter referred to as the Regulation).
This revision is mainly to clarify labeling elements and add minimum dimensions of labeling for containers or packaging. This article will focus on compliance requirements for labeling toxic and concerned chemical substances.
Labeling elements
As per the Regulation, toxic and concerned chemical substances shall be classified according to CNS 15030 Classification and Labeling of Chemicals. Depending on classification results and the volume of containers or packaging, there are three labeling scenarios:
Chemicals classified as per CNS 15030 and the volume of containers or packaging exceeds 100ml
Take nitrous oxide as an example:

Chemicals classified as per CNS 15030 and the volume of containers or packaging less than 100ml
Take nitrous oxide as an example:

Only the name, pictogram, and signal words are required to be indicated on the labeling.
Chemicals judged as “Not Classified” as per CNS 15030 but contain toxic or concerned chemicals that exceed control concentration

The labeling shall be indicated with the name, hazard ingredients, as well as the name, address and telephone number of manufacturer, importer or supplier.
Minimum dimensions of labeling for containers or packaging

If the dimension requirements cannot be met due to reasons such as limited space, special materials, alternative methods such as folded labeling, hanging labeling or outer packaging labeling can be adopted, and the dimensions of labeling are not subject to the abovementioned limits.
Compliance strategies
As stipulated by the Regulation, requirements for labeling elements and minimum dimensions will take force on October 31, 2023. Companies should update their labeling accordingly before the effective date. Here are some dos:
Identify if your product contains ingredients listed as toxic or concerned chemical substances;
Indicate the words "toxic chemical substances" or "concerned chemical substances" and the weight percentages if the toxic or concerned chemical substances exceed the control concentration;
Include necessary warnings, for example, for nitrous oxide (laughing gas), the words 「限工業用、禁止吸食」(industrial use only, no inhaling) shall be indicated;
Paste or print a clear and visible label in accordance with the requirements for minimum dimensions.
