California Aims to Ban More Hazardous Chemicals in Food Packaging

If adopted, California will ban the distribution, selling, or offering for sale any food packaging that contains ortho-phthalates, bisphenol A, B, S, F, or AF, or related compounds and antimony trioxide from January 1, 2027.

On February 20, 2025, the State of California introduced the Assembly Bill No. 1148 "Safer Food Packing Act of 2025" (AB 1148). 

This bill would prohibit a person from distributing, selling, or offering for sale in the state any food packaging that contains the following hazardous chemicals: 

  • Ortho-phthalates.

  • Bisphenol A, B, S, F, or AF, or related compounds.

  • Antimony trioxide. 

If approved, the ban will take effect on January 1, 2027. 

Any person in violation of this regulation shall be liable for a civil penalty not to exceed five thousand dollars ($5,000) for the first violation and not to exceed ten thousand dollars ($10,000) for each subsequent violation.

In addition, the existing California Law (Assembly Bill No. 1200) has prohibited a person from distributing, selling, or offering for sale in the state any food packaging that contains regulated perfluoroalkyl and polyfluoroalkyl substances or PFAS from January 1, 2023.
