China New Anti-Terrorism Law to Impact HazChem Industry

China passed the Anti-Terrorism Law at the 18th meeting of the Twelfth Session of the Standing Committee of the National People’s Congress on Dec 27, 2015. In Article 22, the Law requires manufactures and importers to attach electronic tracking tags to weapons, hazardous chemicals, explosives for civil uses, nuclear and radioactive articles, etc. Transporters of hazardous chemicals, etc. should monitor the working logistics and transport vehicles using GPS tracking.

Noncompliant enterprises are subject to a fine of less than 100,000 RMB and persons directly responsible for breaches are subject to an individual fine of 10,000 RMB.

The Law will come into force on Jan 1st, 2016. There hasn’t been any sub-regulation, official guidance or technical standard defining a hazardous chemical in this legal context, how the electronic tracking tags should be prepared and when industry stakeholders must fulfill the obligation.
