On October 8, 2024, The USA’s Environmental Protection Agency (EPA) is proposing a rule to add 16 individually listed per- and polyfluoroalkyl substances (PFAS) and 15 PFAS categories representing over 100 individual PFAS to the Toxics Release Inventory (TRI) list of toxic chemicals subject to reporting under the Emergency Planning and Community Right-to-Know Act (EPCRA) and the Pollution Prevention Act (PPA). EPA is inviting public comment on the proposed rule until December 9, 2024.
These PFAS are being proposed for inclusion to the TRI based on their toxicity to human health, the environment or both.

The proposed rule includes setting a manufacturing, processing, and otherwise use reporting threshold* of 100 pounds for each individual PFAS chemicals and PFAS categories. All chemicals proposed under this rule would be designated as chemicals of special concern, which would require stricter reporting requirements even for small concentrations.
*EPCRA section 313 requires owners/operators of certain facilities that manufacture, process, or otherwise use listed toxic chemicals in amounts above reporting threshold levels to report their facilities' environmental releases and other waste management information on such chemicals annually. These facility owners/operators must also report pollution prevention and recycling data for such chemicals, pursuant to section 6607 of the PPA
If finalized, this change would improve reporting on PFAS by ensuring that facilities would not be able to avoid reporting on PFAS that are similar to one another if each PFAS does not meet the reporting threshold individually.
EPA is also proposing to reclassify some PFAS that were previously added to the TRI individually as part of one of the 15 PFAS categories. This would change these chemicals from being individually listed to being part of the applicable chemical category.
Finally, EPA also addresses what events may trigger the automatic addition of PFAS to the TRI list pursuant to NDAA framework.
