EU Consults on Introducing UV-328 under POPs Regulation

UV-328 will be restricted under POPs Regulation with specific exemptions of UTC.

On July 30, 2024, European Commission opened up a 4-week consultation which proposed to introduce 2-(2H-benzotriazol-2-yl)-4,6 ditertpentylphenol (UV-328) to Part A of Annex I with specific exemptions. 

The draft delegated regulation is open for consultation until August 27, 2024. The amendment is proposed to take effect on February 26, 2025. 

At the eleventh meeting of the Conference of the Parties to the Stockholm Convention, which took place in Geneva, Switzerland in May 2023, it was decided to include UV-328 in Annex A to the Convention with certain specific exemptions.  

UV-328 is used as a UV stabilizer in plastic shrink films, outdoor furniture and clear coat automotive finishes as well as for light stabilization in coatings, acrylonitrile butadiene styrene resin, epoxy resin, fiber resin, polypropylene and polyvinyl chloride (PVC).

To reinforce the application and enforcement of Article 3(1)(b) of POPs Regulation in EU, a limit value is set for UV-328 occurring as an unintentional trace contaminant (UTC) in substances, mixtures and articles. Exemptions are also provided for certain essential applications. The details are shown below:

1. Concentrations of UV-328 equal to or below 1 mg/kg (0,0001 % by weight) where they are present in substances, mixtures or articles.


2. The placing on the market and use of UV-328 shall be allowed for the following purposes:


(a) in land-based motor vehicles, until 26 February 2030;


(b) in mechanical separators in blood collection tubes, until 26 February 2030;


(c) in triacetyl cellulose film in polorisers, until 26 February 2030;


(d) in photograhpic paper, until 26 February 2030.


(e) spare parts for any of the following:
(i) land-based motor vehicles;
(ii) stationary industrial machines for use in
agriculture, forestry and construction;
(iii) liquid crystal displays in instruments for analysis, measurements, control, monitoring, testing, production and inspection, other than for medical applications.

where UV-328 was initially used in their production, until the end of their service life or 2044, whichever comes earlier; 


(f) spare parts for any of the following:

(i) liquid crystal displays in devices within the
scope of Regulation (EU) 2017/745, and within the scope of Regulation (EU) 2017/746;

(ii) liquid crystal displays in instruments for analysis, measurements, control, testing,

production and inspection.

3. Articles containing UV-328 already in use in the Union before or on the date of expiry of the relevant exemption laid down in paragraph 2(a) to (f) may continue to be used.
