On July 24, 2026, the European Commission published a draft delegated regulation proposing amendments to the Prior Informed Consent (PIC) Regulation (EU) No 649/2012. The draft regulation updates Annex I and Annex V to align the EU's export and import rules for hazardous chemicals with recent domestic regulatory actions and international convention decisions.
The major amendments are summarized below:
Updates to Annex I (chemicals subject to the PIC procedure and export notification)
The following substances are proposed to be added to the lists in Parts 1 and 2 of Annex I:
Flufenacet (CAS No. 142459-58-3): A pesticide whose approval was not renewed.
Acibenzolar-S-methyl (CAS No. 135158-54-2): A pesticide whose approval was withdrawn.
2-methyl-1,2-benzisothiazol-3(2H)-one (MBIT) (CAS No. 2527-66-4): A biocide with severely restricted use.
Disodium octaborate tetrahydrate (CAS No. 12280-03-4): A substance whose approvals for use in biocides and plant protection products have expired.
Diboron trioxide (CAS No. 1303-86-2): A substance whose approval for use in biocides has expired.
Boric acid (CAS No. 11113-50-1; 10043-35-3): A substance whose approval for use in plant protection products has expired.
Lead chromate (CAS No. 7758-97-6): To be added with a specific entry indicating its severe restriction for professional use.
Other hazardous substances: Including various phthalates, cobalt compounds, Bisphenol A, N,N-dimethylformamide, which are classified as carcinogenic, mutagenic, or toxic for reproduction (CMR) 1A or 1B in accordance with Regulation (EC) No 1272/2008 (EU CLP) and are covered by entries 28, 29 or 30 of Annex XVII to Regulation (EC) No 1907/2006 (EU REACH) . Therefore, they are banned from placing on the market and use for supply to the general public.
Updates to Annex V (Chemicals Subject to a Ban on Export)
New Additions: The following substances are proposed to be added to Part 1 of Annex V, which would prohibit their export:
Chlorpyrifos (removed from Part 1 of Annex I, as its export will be banned rather than just subject to notification ), CAS No. 2921-88-2
Medium-chain chlorinated paraffins (MCCPs), CAS No. 85535-85-9, 198840-65-2, 1372804-76-6, and others
Long-chain perfluorocarboxylic acids, their salts, and related compounds (C9-21 PFCAs), CAS No. 2058-94-8, 375-95-1, 72629-94-8, 307-55-1, 335-76-2, 376-06-7, 67905-19-5, 16517-11-6, 68310-12-3, 141074-63-7, 57475-95- 3, 133921-38-7, and others
Updates for certain chemical: The entries such as PFOS, PFOA, PFHxS, decaBDE, heptabromodiphenyl ether will be updated to reflect the technical adjustments for specific exemption and contaminant limits to align with POPs Regulation.
The draft delegated act is currently open for public consultation, with a feedback deadline of August 21, 2026. The European Commission is expected to formally adopt the regulation in the third quarter of 2026. The regulation will enter into force on the twentieth day following its publication in the Official Journal of the European Union. To provide industry stakeholders sufficient time to adapt, the provisions will apply either two months after the date of entry into force or from April 1, 2027, whichever date is later.
