Hazardous Chemical Supervision in Shanghai Free Trade Zone

Enterprises in Shanghai Free Trade Zone (FTZ) enjoy many favorable policies. In terms of chemical management, the current policies are being trialed with a view to simplifying compliance procedures while still ensuring work safety and protection of human health.

The principle of Shanghai Free Trade Zone’s chemical management is to simplify compliance procedures while still ensuring work safety and protection of human health. The current hazardous chemical supervision policy in Shanghai’s Free Trade Zone was spoken about by Director Xu of Shanghai Chemical Registration Office during a CRAC 2014 follow-up meeting.

Basically Shanghai adopts a negative-list system in hazardous chemical management in the FTZ. Companies and chemicals in the zone are exempted from any compliance inspections from the local administration of work safety until a workplace accident happens. This means shipping hazardous chemicals to Shanghai FTZ and storing them there does not require HazChem registration certificates.

This loose management mode is currently being assessed. Policies and administrative rules are likely to be tightened if these expedited compliance measures result in reduced safe production/use/operation conditions and/or result in a serious incident.

For chemicals exported to the Chinese market through Shanghai’s FTZ the materials required for customs clearance are the same as specified in AQSIQ Announcement No.30 of 2012. Director Xu also mentioned that Shanghai CIQ conducts strict inspections of SDSs and labels while the registration certificates can be used as proof of GHS compliance. Thus acquiring Hazchem registration certificates before customs clearance is not compulsory but highly recommended. Anyway, as long as the goods stay in the FTZ, importers still have plenty of time to prepare China GHS-compliant labels and SDSs and acquire registration certificates if the work hasn’t been completed before arrival.
