On October 15, 2021, Japan’s Ministry of Economy, Trade and Industry (METI) revised the Ministerial Order Specifying Goods and Technologies Pursuant to the Provisions of the Appended Table 1 of the Export Trade Control Order and the Appended Table of the Foreign Exchange Order[1] (Hereinafter referred to as the Order) to add 24 substances in its Article 2 as the raw materials for chemical warfare agents. The Order will be implemented from December 15, 2021, after which the export of these substances (including mixtures wherein the content of any of the substances exceeds 30 % of the total weight) from Japan will require a permit from METI.

The Order was issued in 1991 by the previous Ministry of International Trade and Industry (MITI) (renamed as the Ministry of Economy, Trade and Industry in 2001) based on the provisions of the Export Trade Control Order[2] and the Foreign Exchange Order[3], which are the subordinate regulations of the Foreign Exchange and Foreign Trade Act[4] (hereinafter referred to as the Act). The last revision was made on December 10, 2020.
The purpose of this Act is to ensure the peace and security in international society by restricting the circulation of technologies and goods including nuclear, biochemical, missile, and conventional weapons in the international market. It reflects the latest resolution of various international Multilateral Export Control Regimes (MECR) implemented in Japan, including NSG (Nuclear Suppliers Group), AG (Australia Group), MTCR (Missile Technology Control Regime), WA (Wassenaar Arrangement), etc.
