Japan Nominates 27 Substances Subject to Mandatory Labeling, SDS and Risk Assessment under ISHL

On Dec 8, the Japanese Ministry of Health, Labor and Welfare published the draft partial amendments to the Order for Enforcement of Industrial Safety and Health Law which proposes to add 27 more substances to Appended Table 9 of the Enforcement Order.

The nominated chemicals will be subject to mandatory labeling in accordance with Article 57-1 of the Industrial Safety and Health Law as amended by Act No.82 of Jun 25, 2014, as well as mandatory SDS supply in accordance with 57-2 (1) and hazard assessment in accordance with 57-3 (1). Along with the amendments, the Ordinance of MHLW on ISH will also be amended to include the following information:

The amendments are scheduled to take effect from Mar 1, 2017, except the labeling requirement under Article 57-1 of ISHL which will not be applicable until Aug 31, 2017.

The consultation will conclude on Jan 7, 2016, while companies outside Japan can still submit comments to Japan External Trade Organization (JETRO) before Feb 15, 2016.
