Japan Releases Revised Chemical Substance Lists under PRTR

The number of Class I substances and Class II substances was respectively increased from 462 to 515 and from 100 to 134, which will take effect from April 1, 2023.

On October 15, 2021, the Ministry of Economy, Trade and Industry, the Ministry of Health, Labor and Welfare, and the Ministry of the Environment jointly announced that the revised Enforcement Order of the Pollutant Release and Transfer Register (PRTR) Law is expected to be officially published on October 20, 2021 and will be implemented on April 1, 2023.

The Enforcement Order of the PRTR Law specifies the lists of chemical substances subject to the PRTR Law, including Class I designated chemical substances and Class II designated chemical substances.

Compared to the current version, the adjustments to the lists include:

  1. deleting 86 Class I substances and 78 Class II substances;

  2. changing 56 Class I substances to Class II substances and changing 12 Class II substances to Class I substances;

  3. adding 188 new Class I substances and 68 new Class II substances;

  4. combing some substances with similar chemical structures

  5. listing organotin compounds separately.

As a result, the number of Class I substances is increased from 462 to 515, and the number of Class II substances is increased from 100 to 134.

Although compared with the last year's consultation version of the lists (Chemlinked news), the number of Class I substances in the new version is only reduced by one, minor adjustments have been made including the adjustment of substance names and the combination of substances, etc.

In addition, since substances in the original lists are ordered by kana alphabetic order, the revisions to designated substances, which includes both additions and deletions, will inevitably make them out-of-order. Therefore, a change was also made to assign administrative number to each substance, so that their numbers will not be changed due to any deletion or addition. This will make it more convenient for businesses to check whether they need to fulfill obligations under the PRTR framework for any substances. The administrative number will apply in PRTR reporting system from 2024. Businesses are not required to state the administrative number in SDSs.
