Mexico Revises Import and Export Rules for Toxic Substances

Importers or exporters of the listed toxic chemicals need to file for the Registry of Verification by PROFEPA together with authorization by SEMARNAT before custom clearance.

Starting from April 13, 2024, Mexico is requesting a Registry of Verification (RV) issued by the Federal Attorney for Environmental Protection (PROFEPA) for import and export of certain toxic substances listed in subparagraph (d) of Annex I to Agreement that establishes the goods whose import and export are subject to regulation by the agencies that make up the Inter-Ministerial Commission for the Control of the Process and Use of Pesticides, Fertilizers and Toxic Substances(hereinafter referred to as the Agreement).

The Agreement was promulgated on the Federal Official Gazette on December 26, 2020. It established a list of pesticides, fertilizers and toxic substances which require an import or export permit/authorization from the Federal Commission for the Protection against Sanitary Risks (COFEPRIS) and the Ministry of Environment and Natural Resources (SEMARNAT).

What's New?

Under the new rules, the RV is certified by PROFEPA to prove compliance with appropriate authorization issued by SEMARNAT for custom clearance.

To apply for RV, the applicant must file the same documentation with PROFEPA that they previously submitted to SEMARNAT to request the import or export authorization.

PROFEPA is responsible for conducting a thorough review to ensure compliance with all requirements, following which the RV will be issued to proceed the release of the shipments.

In addition, for substances not listed in Annex I but are susceptible for diversion for the production of chemical weapons, the exporters are required to consult the Ministry of Economy before applying for export authorization.
