The U.S. state of Minnesota has again postponed the deadline for initial reporting of per- and polyfluoroalkyl substances (PFAS) in consumer products. The Minnesota Pollution Control Agency (MPCA) announced that the new due date for the first PFAS product disclosure is now September 15, 2026.
As required under Minn. Stat. § 116.943, subd. 2, manufacturers(including importers) are required to report intentionally added PFAS in products and pay a fee. The reporting information include a description of the product, the purposes/functions that PFAS play in the product, the amount of each type of PFAS, and other information.
MCPC has also created the PFAS Product Reporting Information System for Manufacturers (PRISM) for manufacturers and their representatives to submit PFAS in product reports and pay related fees.
For manufacturers that are unable to fulfill reporting before the due date, they may request a one-time 90-day extension. Additionally, companies may apply for a waiver if substantially equivalent PFAS information about their products is already publicly available. Both extension and waiver requests must be postmarked by August 16, 2026.
Beyond the initial filing, ongoing compliance includes an annual update requirement. Manufacturers must submit updated reports by February 1 of each subsequent year if any of the following occur:
A significant change is made to the product formulation;
New information about PFAS content is provided to the manufacturer; or
A new product containing PFAS is introduced into Minnesota's market.
