On May 28, 2023, Peru's Minister of the Environment (MINAM) approved Legislative Decree No. 1570 and published it on the Official Gazette, which marks the implementation of national chemical management framework. It establishes a National Registry of Chemical Substances (RENASQ) and a process for risk assessment of priority substance.
As per the Decree, the classification, SDS, and labeling is carried out in accordance with the United Nation's Globally Harmonized System of Classification and Labeling of Chemicals (GHS) and the provisions of this Decree. The Ministry of the Environment (MINAM) shall issue a prelist of hazard classification of chemical substances and update it at least every two years.
National Registry of Chemical Substances (RENASQ)
The National Registry of Chemical Substances (RENASQ) is created as a mechanism to manage the risks associated with chemical substances that are manufactured or imported in the country. It is administered by MINAM and is connected to the National System of Environmental Information (SINIA).
The following information is required when registering with RENASQ:
Details of the manufacturer or importer, as well as the supplier in case of importation;
Identification of the chemical substance, including the IUPAC (International Union of Pure and Applied Chemistry); nomenclature and CAS (Chemical Abstracts Service) number, when it exists;
Recommended use(s) of the chemical;
Quantity manufactured or imported of the chemical substance;
Content of the SDS;
The risk assessment of chemical substances for health and the environment (when appropriate).
Risk assessment of chemical substances for health and the environment
The risk assessment of chemical substances for health and the environment is submitted to the Ministry of Health (MINSA) for its approval, after a favorable technical opinion from MINAM. The risk assessment shall be evaluated and approved within 75 working days.
The preparation of risk assessment is based on the guidelines established by MINSA, and shall consider the following: the
The determination of the physical and chemical properties;
Effect on biotic systems;
Mobility and behavior in the environment;
Effect on human health.
It should be noted that the detailed information on the operation and implementation of RENASQ and procedures for risk assessment shall come in the regulation of this Decree later.
The Decree enters into force on May 28, 2023.
