Shandong Province Cancels 200+ HazChem Management and Work Safety Licenses

Recently, Shandong administration of work safety abolished the work safety and hazardous chemical management licenses of over 200 enterprise. The reasons for cancellation include license expiration, excessive safety risks, and ceased production.  

In the city of Pingdu, the work safety licenses of 11 coal companies were revoked. Similarly, in the city of Linyi 197 hazardous chemical operating licenses were canceled. Overall, over 200 enterprises lost their HazChem management and work safety licenses, which means they are no longer permitted to engage in associated activities. 

The whole investigation and penalties are based on the Measures for the Administration of Operating Licenses for Hazardous Chemicals (SAWS Order 55) and the Regulation on Work Safety Licenses.

SAWS order 55 was finally published on 21 May 2012, laying out the requirements and procedures for HazChem management license according to decree 591. As is regulated in the SAWS order 55, enterprises shall obtain a license from SAWS prior to engaging in retail, wholesale, or storage of hazardous chemicals in China. For those who have already obtained a license, their license shall be cancelled in the following situations:

  1. The license exceeds its validity and no extension is permitted.

  2. The enterprise has halted production.

  3. The license is withdrawn by SAWS according to the regulation.

    *SAWS shall withdraw the license if the enterprise obtains the license by illegal means such as bribery or deception.

  4. The license is cancelled by SAWS due to enterprise’s incompliance.   

SAWS suggests that enterprises should strictly follow the relevant laws and regulations, make timely rectifications to safety risks and remember to renew certificate before its expiration.
