On December 13, 2022, according to MoE Notification No. 2022-501, South Korea’s Ministry of Environment (MoE) consulted on the draft amendment to the Designation List of Existing Biocidal Substances Subject to Deferred Approval.
Background
Enacted in 2018, the Consumer Chemical Products And Biocides Safety Control Act requires manufacturers and importers of biocidal substances to obtain approval from the Ministry. Biocidal substances placed in Korea before December 31, 2018, are allowed to be designated as “existing biocidal substances subject to deferred approval” and manufactured or imported without obtaining the approval within their grace period if their producers and manufacturers fulfilled reporting and submission obligations.
The main amendments include the following:
Add 5 types of designated biocidal products subject to deferred approval;
Add 12 designated biocidal substances subject to deferred approval;
Cancel 109 designated biocidal substances subject to deferred approval;
Cancel 106 types of designated biocidal products subject to deferred approval;
Change the serial numbers from “2” to “452” to “1” to “343”.
Companies are advised to check if the biocidal products they produce or import in South Korea are concerned with the status shifts of deferred approval, and take countermeasures in a timely manner.
