On August 31, 2021, Taiwan EPA released the revised Guidelines of the Criteria of Fines for Violating the Toxic and Concerned Chemical Substances Control Act to tighten controls over the listed toxic and concerned chemical substances.
The main amendments of the Guidelines are as follows:
(1) The competent authority may impose a fine of 3 to 10 times on the illegal operation of listed toxic and concerned chemical substances. A statutory maximum fine may be imposed on serious violations and illegal gains may be confiscated. (Article 2)
(2) Adding the penalties for violations of the Article 14 Paragraph 9 of the Measures for the Establishment and Management of Professional Technical Management Personnel for Toxic and Concerned Chemical Substances. (Annex 1 and 2)
(3) Amending the weight of factors and the formula in calculating the penalty in non-compliance of registration and reporting of new chemical substances and existing substances. (Annex 3)
Toxic and Concerned Chemical Substances Control Act (TCCSCA) is the most important chemical control law in Taiwan. It is enacted to prevent toxic and concerned chemical substances from polluting the environment and endangering human health, and to manage all relevant information on domestic chemical substances to serve as a basis for the screening, selection and assessment of toxic and concerned chemical substances. Companies engaged in the manufacture, import, export, sales, transport, use, storage or disposal of toxic and concerned chemical substances in Taiwan shall comply will the Act, otherwise they will be punished greatly. For example, the violation in the operation of nitrous oxide, which was listed as the first concerned chemical substance, will face a fine up to NT$ 300,000.
