Taiwan to Tighten Control on Organotin Compounds

Taiwan EPA to strengthen source control and use safety of organotin compounds.

On October 4, 2022, Taiwan’s EPA issued a notice to commence a period of public comments for the Draft Amendments to Categories and Management of Handling for Toxic Chemical Substance (hereinafter referred to as the Draft Amendments) under Taiwan TCSCA. The Draft Amendments proposed to update the toxicity classification and handling requirements of 10 existing organotin compounds and add CAS numbers for 4 new organotin compounds. Once approved, a grace period of 1~2 year(s) will be provided for enterprises to comply with the corresponding requirements. Comments are welcome before November 3, 2022.

Organotin compounds are endocrine disrupters. They are widely used as polyvinyl chloride (PVC) stabilizers, biocides, or anti-fouling paints, and have given rise to ubiquitous environmental contamination. Currently, under Taiwan TCSCA, there are 35 organotin compounds designated as toxic chemicals by Taiwan EPA. In line with international regulations, Taiwan EPA proposes more use prohibitions on more substances to strengthen the source control and safety use of organotin compounds.

Proposed updates are summarized as below:

Note: For Class 1, Class 2 and Class 3 toxic chemical substances under Taiwan TCSCA, the authority may restrict or prohibit their handling. Prior to the handling of Class 4 toxic chemical substances, toxicity and relevant information of these substances shall be reported to the relevant authorities. Such handling shall be performed upon permission in compliance with authorized items.

Besides, the Draft Amendments also expand the types of asbestos subject to ban on the manufacture, import, sell and use, i.e.,:

  • Crocidolite;

  • Amosite;

  • Anthophyllite (to be added) ;

  • Actinolite (to be added);

  • Tremolite (to be added);

  • Chrysotile (to be added).

Except for R&D, testing and education applications, the Draft Amendments delete all the permitted uses of asbestos (as the corresponding exemption period is going to expire).
