On March 27, 2026, the U.S. Environmental Protection Agency (EPA) released a proposed rule on the Federal Register to extend certain Workplace Chemical Protection Program (WCPP) compliance dates for perchloroethylene (PCE) and carbon tetrachloride (CTC) under the Toxic Substances Control Act (TSCA).
The proposed extensions aim to align non-federal compliance deadlines with those currently established for federal agencies. Under the proposed rule, the EPA will extend compliance deadlines for the following activities:
Initial Monitoring: For both PCE and CTC, the deadline to conduct initial monitoring for inhalation exposure will be extended to June 21, 2027.
Existing Chemical Exposure Limit (ECEL) and Respiratory Protection: For both PCE and CTC, the compliance date to meet the ECEL, establish a regulated area, provide any required respiratory personal protective equipment (PPE), and establish a respiratory PPE program will be shifted to September 20, 2027.
Exposure Control Plan: For PCE specifically, the deadline to establish and implement an exposure control plan will be extended to December 20, 2027.
The EPA emphasized that the proposed extensions apply strictly to WCPP compliance dates related to the ECEL and inhalation exposure. The agency is not proposing to extend the WCPP compliance dates to implement the dermal protection requirements mandated by the 2024 PCE and CTC Final Rules.
Industry professionals and stakeholders are invited to submit public comments regarding regulated entities' ability to comply with both the original WCPP compliance deadlines and the proposed extensions. The final date for the provision of comments is April 27, 2026.
