U.S. Senate Committee Examines Discussion Draft for TSCA Fee Reauthorization and New Chemical Review Reforms

The U.S. Senate is considering the TSCA Fee Reauthorization and Improvement Act of 2026, which would renew expiring TSCA user fees and significantly reform EPA’s new chemical review process through clarified risk definitions, tiered reviews, stewardship pathways, and use of third‑party assessors.

On March 4, 2026, the U.S. Senate Environment and Public Works (EPW) Committee held a legislative hearing to examine a discussion draft of the Toxic Substances Control Act (TSCA) Fee Reauthorization and Improvement Act of 2026. The hearing addressed two critical priorities for the chemical industry: reauthorizing TSCA user fees, which are set to expire on September 30, 2026, and instituting structural reforms to the U.S. Environmental Protection Agency's (EPA) new chemical review process.
