Vietnam Updates List of POPs for Exemption Registration

From January 1, 2023, companies need to obtain notices of approval of POP exemption registration from MONRE to import POPs.

On February 2, 2023, Vietnam's Ministry of Natural Resources and Environment (MONRE) issued an official letter 424/BTNMT-KSONMT 2023 to supplement the legal provisions on exemption registration for persistent organic pollutants (POPs) under Decree No. 08/2022/ND-CP detailing a number of articles of the Law on Environmental Protection (hereinafter referred to as the Decree). 

As per the Decree, organizations and individuals that import, produce or use POPs as production materials shall register for POP exemption (the list of POPs is specified in Appendix XVII of the Decree). Starting from January 1, 2023, MONRE's notice on approval of POPs exemption registration serves as a basis for customs authorities to consider and permit customs clearance for POPs. 

To implement the requirements of the Stockholm Convention on the management of POPs and clarify the regulated scope of imported POPs, MONRE has reviewed and updated the list of POP substances as follows: 

  • Appendix 1: List of POPs that are not allowed to be imported (with the expiration of exemption registration)

  • Appendix 2: List of POPs allowed to be imported provided that the notice of exemption registration is granted

Compared with the list of POPs under the Decree, the updated list introduces PFHxS, its salts and related compounds as it has been added to Annex A of the Stockholm Convention at the 10th Conference of the Parties to the Stockholm Convention in June of 2022. 

In order to ensure the effective implementation of regulations on POPs exemption registration, MONRE also requests the Minister of Industry and Trade and the Ministry of Finance to share information and enhance coordination in management of POPs and custom clearance.
