Japan Seeks Public Feedback on Re-categorization of Substances Subject to SDS and Labelling Requirements

The Japanese Ministry of Health, Labour and Welfare (MHLW) has opened a public consultation period until July 20, 2023, seeking opinions on the revision of the Enforcement Order of the Industrial Safety and Health Law (ISHL). The purpose of the revision is to re-categorize substances that are subject to mandatory SDS and labelling requirements. It is expected to be finalized in early August 2023.

Peru Publishes Legislation on National Chemical Management

On May 28, 2023, Peru's Minister of the Environment (MINAM) approved Legislative Decree No. 1570 and published it on the Official Gazette, which marks the implementation of national chemical management framework. It establishes a National Registry of Chemical Substances (RENASQ) and a process for risk assessment of priority substance.

Brazil Moves Forward with New Chemical Law

On May 9, 2023, Brazil’s Constitution, Justice and Citizenship Commission (CCJC) approved the National Chemical Law (PL 6120/19). The Bill will now be submitted to Senate for consideration. Once passed, the Bill will serve as the Brazil REACH Regulation and make Brazil the third countries in South America to establish a chemical management law after Chile and Colombia.

On April 9, 2021, Colombia issued Resolution 0773/2021 to implement GHS in the workplace. Chemical products should be classified in accordance with the sixth revised edition of the Globally Harmonized System of Classifying and Labeling of Chemicals (GHS Rev.6), as well as the labeling and Safety Data Sheets (SDS).
