Manufacture and Import of Plant Extract: Compliance with China REACH

While the cosmetic finished products are not under the supervision of the MEP (the SFDA is in charge of cosmetics management), the manufacture and importation of cosmetic ingredients in China are under the control of the “Measures on the Environmental Management of New Chemical Substances” (dubbed as China REACH, MEP Order 7) in China, the same as industry chemicals.

The harmful effects of chemicals can be broadly categorized as acute or chronic. This broad distinction also serves as a regulatory divide for management of chemicals from a work safety and environmental perspective. In China hazardous chemicals are primarily governed by two authorities, the State Administration of Work Safety (SAWS) and the Ministry of Environmental Protection (MEP). The former is in charge of preventing chemical accidents in the work place, which generally involving the “acute risks”, while the MEP focuses on health, emission, and other environmental concerns.

Applying Generic Names in Your China New Substance Notification

China’s New Chemical Substance Notification allows the applicants to claim confidentiality for key substance information as registered uses, domestic downstream processor or user, registered substance identification information like the chemical name, CAS number, molecular formula and structural formula, production processes, exposure and use, etc. Besides, China’s Ministry of Environmental Protection (China MEP) do not charge anything for the confidentiality claiming.
