MEP’s First Chemical “Blacklist” Prioritizes Assessment of Acute Effects and Excludes Numerous EDCs

It has been more than one year since MEP started to implement the Measures for the Registration of Hazardous Chemicals for Environmental Management (trial) (MEP order 22). Only recently in April, 2014 did the Ministry officially issue the List of Hazardous Chemicals of Priority Environmental Concern, which includes 84 chemical substances.

Overview of Hazardous Chemicals Management in China

A number of inventories involved in the management of hazardous chemicals compiled by different authorities are combed with a “historical review” in this article. Meanwhile, the inventories/catalogues newly developed since the enactment of the “Regulations on the Control over Safety of Hazardous Chemicals” (State Council Decree No. 591) are introduced with respect to their drafting background, main content and application scope.

A Comparative Analysis of MEP Order 22 and SAWS Order 53

With the implementation of “Regulation on the Control over safety of Hazardous Chemicals (Decree 591)” on 1 December 2011, China has entered a new stage of management on hazardous chemicals. As stipulated in the Decree 591, the environmental Protection authority shall be responsible for the environmental management registration on HCs. Thus, the “MEP Order No 22: Measures for the Environmental Management of Hazardous Chemical Registration (Trial)" was drafted and approved by the Ministry of Environmental Protection (MEP). The legal text was published on 10 Oct 2012 and the measures will take effect on 1 Mar 2012.

MEP Order No 22: Current Status and Future Direction

The harmful effects of chemicals can be broadly categorized as acute or chronic. This broad distinction also serves as a regulatory divide for management of chemicals from a work safety and environmental perspective. In China hazardous chemicals are primarily governed by two authorities, the State Administration of Work Safety (SAWS) and the Ministry of Environmental Protection (MEP). The former is in charge of preventing chemical accidents in the work place, which generally involving the “acute risks”, while the MEP focuses on health, emission, and other environmental concerns.
