Canada Amends CPEA Schedule 3 to Establish Export Controls on Six Kinds of Substances

Canada has amended Schedule 3 of CEPA to add PFAS, certain flame retardants, and pesticides to the Export Control List, tightening export notification and permitting requirements in line with the Rotterdam and Stockholm Conventions and recent domestic prohibitions.
On February 16, 2026, Canada's Ministry of the Environment and the Ministry of Health issued the Order Amending Schedule 3 to the Canadian Environmental Protection Act, 1999 (SOR/2026-28). This regulatory update adds several hazardous substances to the Export Control List (ECL), thus making them subject to the regulatory controls under the Export of Substances on the Export Control List Regulations (ESECLR) and ensuring Canada's continued compliance with the Rotterdam Convention.
