On August 2nd, 2021, the China Ministry of Emergency Management (MEM) issued its Order No.6 [1] to publish the Safety Regulations on Dust Explosion Protection for Industry and Trade Enterprises. The Regulations are formulated in accordance with the newly issued Work Safety Law and will enter into effect on September 1st, 2021, simultaneously with the Law.
The Regulations consist of five chapters as follows:
Chapter 1 General Provisions, which specifies the background, terms and definitions, main responsibilities, and authorities;
Chapter 2 Guarantee of Safe Production, which specifies the person responsible for dust explosion protection, the safety management system, risk factors identification, explosion-proof measures, etc.
Chapter 3 Supervision and Inspection, which specifies the responsibilities of authorities on inspections, key inspection items, testing and examination, etc.
Chapter 4 Legal Responsibilities, which specifies the violation circumstances and corresponding penalties;
Chapter 5 Supplementary Provisions, which specifies that the implementation date of the Regulations.
The Regulations apply to the dust explosion safety work and supervision and management of industrial and trade enterprises with a risk of flammable dust explosion. Enterprises related to dust explosion shall take the main responsibility for dust explosion safety work. In terms of basic management, the focus is on the safety management system, education and training, labor protection equipment, emergency rescue plans and drills, risk identification and hidden danger investigation, and the "three simultaneous" safety facilities. At the same time, source control is also emphasized. In terms of on-site management, the Regulations clarify the technical guarantee requirements for key links, effectively link up with relevant national standards and industry standards, and focus on the structural layout, safety distance, dust removal system explosion-proof measures, Specific provisions have been made for typical processes, safety equipment, dust cleaning and disposal, overhaul and maintenance, and outsourcing operations.
On June 10, 2021, a revision to the Work Safety Law of the People’s Republic of China was adopted at a meeting of China’s top legislative body (ChemLinked News [2]). The revision has improved the responsibility system for production safety and involves precautions for and solutions to new problems and risks.
