China MEE to Further Standardize Discharge Management of Industrial Solid Waste

The draft standard specifies requirements for information report, pollution prevention and control, and environmental management ledgers and discharge permit implementation reports preparation of industrial solid waste discharge units, and the compliance determination methods, etc.

On June 24th, 2021, the China Ministry of Ecology and Environment (MEE) issued a notice [1] to publish the draft ecology and environment standard Technical specification for application and issuance of pollutant permit Industrial solid waste management (on trial) and solicit public comments. Enterprises and individuals shall submit comments and suggestions to MEE in writing (electronic documents should be sent to [email protected] at the same time). The public consultation will conclude on July 22nd, 2021.

In April 2020, the revised Law of the People’s Republic China on the Prevention and Control of Environmental Pollution by Solid Waste was approved by the National People Commission Standing Committee, in which the requirement of including industrial solid waste in the pollution discharge permit system for supervision was added (ChemLinked News [2]). By now, there has not been a sufficient technical system to include industrial solid waste in the pollution discharge permit system, and the supported documents and targeted governing measures are lack. This standard will provide specifications on the requirements for the basic information filling and report of the industrial solid waste, the technical requirements for the pollution prevent and control, requirements for the preparation of environmental management ledgers and discharge permit implementation permit, and compliance determination methods, etc.

When applying for the pollution discharge permit, discharge units of industrial solid waste shall fill in the relevant information separately in accordance with the requirements of this standard for hazardous waste and general industrial solid waste, including basic information (name, code, etc.), self-storage facility information, and self-disposal facility information. For pollution prevention and control, general rules, and specific technical requirements for hazardous waste and general industrial solid waste are provided. For the preparation of environmental management ledgers, the general rules, record content, and record frequency are specified. 

According to the standard, the following circumstances shall be deemed non-compliant:

  • The environmental management and operation and maintenance of related facilities during the production and operation of the pollutant discharge unit do not meet the requirements of standards such as GB 15562.2, GB 18484, GB 18597, GB 18598, GB 18599, GB 30485, HJ 2025, HJ 2035 and HJ 2042, etc.

  • Fail to record relevant information in accordance with the requirements of general industrial solid waste or hazardous waste environmental management ledger;

  • Fail to prepare and submit implementation reports as required.

One informative appendix and three normative appendixes are annexed to this standard, namely the Common General Industrial Solid Waste Reference Table (informative), Template of Application Form for Industrial Solid Waste Discharge Permit (normative), Environmental Management Ledger Record Form (normative), and Implementation Report Form (normative). To promote the implementation of this standard, the authority will emphasize the linking with the hazardous waste business license and accelerate the establishment of the IT system for pollution discharge permit system.
