China MIIT Publishes Revised List of Monitored Chemicals

Four kinds of chemicals are officially added into Schedule 1 of the List. The revision takes effect and replaces the old List immediately after issuance.

On June 9, China Ministry of Industry and Information Technology (MIIT) officially released the revised List of Monitored Chemicals [1] as its Order No.52. The revision takes effect immediately after issuance, and the previous version ,Order No.11 of the Ministry of Chemical Industry is repealed at the same time.

China’s List of Monitored Chemicals is the localized inventory of Annex on Chemicals under the Chemical Weapon Convention. To stay consistent with the Convention, which was approved to include more chemicals last November, MIIT supplemented 4 kinds of chemicals in Schedule 1 of the List and launched two rounds of consultation on it earlier this year (ChemLinked News Ⅰ [2]).

The List of Monitored Chemicals includes four Schedules:

  1. Schedule 1: Chemicals that can be used as chemical weapons;

  2. Schedule 2: Chemicals that can be used as precursors to produce chemical weapons;

  3. Schedule 3: Chemicals that can be used as raw materials to produce chemical weapons;

  4. Schedule 4: Specific organic chemicals except explosives and pure hydrocarbons.

The management of the monitored chemicals refers to the Regulations on Administration of Monitored Chemicals and the Implementation Rules (ChemLinked News Ⅱ [3]). The enterprises’ obligations are briefly introduced below:

  • For Schedule 1 monitored chemicals, the production shall be strictly controlled by the state. Those who need to produce Schedule 1 monitored chemicals for scientific research, medical treatment, manufacturing of drugs or protection shall report to the competent authority under State Council for approval and manufacture the chemicals in small facilities designated by the authority. 

  • For Schedule 2, Schedule 3 monitored chemicals, and specific Schedule 4 monitored chemicals that contain phosphorus, sulfur, or fluorine, the production is subject to a special permit system. Production without the permit shall be prohibited, and the rules on the special permit shall be formulated by the competent authority.

  • The use, import, and export of monitored chemicals shall be permitted only after application to authority and being approved.

Besides the List of Monitored Chemicals, the chemicals specified in List of New Kinds of Monitored Chemicals that shall be Included in Schedule 3, which was released by the State Bureau of Petroleum and Chemical Industry in 1998, are also subject to the Regulations and the Implementation Rules.
