EU REACH Bans Newly Classified CMR Substances to Align with CLP

The amendment aligns with the latest newly classfied CMR substances under CLP Reuglation applicable from September 1, 2025.

On August 8, 2025, the European Union published the Commission Regulation (EU) 2025/1731, which introduced new restrictions on several carcinogenic, mutagenic, or reproductive toxic (CMR) substances by adding them to Annex XVII of the REACH Regulation.

Alignment with CLP 

The Regulation reflects the new classification of certain substances as CMR Category 1B under Regulation (EU) 1702/2008 (CLP Regulation) as amended by Delegated Regulation (EU) 2024/197. Since entries 28, 29, 30 of Annex XVII to REACH prohibit CMR Cat. 1A or 1B in accordance with CLP, it is appropriate to include the newly classified CMR substances to Annex XVII.

The inclusion of these newly classified CMR substances in Annex XVII means that their placing on the market and use, particularly for supply to the general public, will be restricted or prohibited.

The restrictions introduced by this Regulation will apply from September 1, 2025. This aligns with the application date the classification itself as introduced by Delegated Regulation (EU) 2024/197, ensuring a consistent regulatory approach.

Specific Exemptions and Considerations

While the regulation broadens restrictions, it also includes specific exemptions. For instance, the restriction on cumene, which was included in Appendix 2 to Annex XVII by Commission Regulation (EU) 2023/1132 as of 1 December 2023, will not apply to aviation fuels. This exemption acknowledges the presence of cumene in certain aviation fuels used by non-professional pilots and the comparatively lower exposure risks in this specific application compared to motor fuels for general public use.
