Ukraine Implements CLP Regulation to Align With EU Standards

Ukraine’s CLP Regulation is consistent with the European standards and provides transition periods for compliance.

On May 10, 2024, the Ministry of Environmental Protection and Natural Resources of Ukraine officially approved the Technical Regulation on Hazard Classification, Labeling and Packaging of Chemical Products (hereinafter referred to as the Technical Regulation). The Resolution on Approval of the Technical Regulation was published on May 15, 2024 and will enter into force on November 15, 2024.  

With this document, Ukraine implements the norms of the relevant European CLP Regulation, as part of its efforts in building a national chemical management system based on the EU model. With regard to the REACH implementation, the Ministry has already developed the Technical Regulation on the safety of chemical products, which will be submitted to the government for consideration in the near future. The document provides for mandatory registration of all chemical substances.

Earlier in December 2022, Ukraine has adopted the Law "On ensuring chemical safety and management of chemical products", which will enter into force on June 29, 2024. This is a framework legislation for EU integration, allowing Ukraine to fulfill part of its European integration commitments, as well as take care of the protection of Ukrainians and the environment.

Key provisions

The Technical Regulation establishes a list of hazardous substances with corresponding hazard classification and labeling elements. The classification criteria is consistent with the 9th Revision of The Globally Harmonized System of Classification and Labeling of Chemicals (GHS).

For manufacturers, importers, suppliers and other operators, they must collect all available information on its hazardous properties, assess the validity of such information and classify the hazards of the chemical substances in accordance with the Technical Regulation before placing a chemical product on the market.

In addition, they must ensure all chemical products are properly packaged and bear the appropriate hazard labeling.

Transition periods

The Resolution provides a transition period for different situations as follows:

  • For chemical products placed on the market before the effective date, they may be placed on the market before November 15, 2025;

  • For substances, if the hazard classification is not carried out as well as no hazard information is provided in accordance with the Technical Regulation, they may be placed on the market until November 1, 2026;

  • For mixtures, if no hazard classification is carried out and no hazard information is provided in accordance with the Technical Regulation, they may be placed on the market until May 1, 2026, and if the mixtures are placed on the market for the first time, until May 1, 2028.
