The European Chemicals Agency (ECHA) plays a leading role among regulatory authorities in implementing the chemicals legislation in Europe. In January 2024, ECHA published its Strategy Statement 2024-2028, which reflects the broadening of ECHA's legal mandate in support of the EU's ambitious goals on chemical safety. Speaking at the ChemCon Asia conference held in Bangkok on June 7, 2024, Mr. Kevin Pollard, an official from ECHA, shared further tasks in the EU legislative phase.
Mr. Pollard summarized a group of tasks that ECHA would focus on, covering the following:
Development and running of an EU common data platform for chemicals, including physio-chemical, hazard, safety, occurrence and emissions related information.
Updating guidance on the presence of phthalates in medical devices and providing ad hoc opinions on the presence of hazardous substances in medical devices.
Developing and/or providing opinions on proposals for restricting hazardous substances under the following regulations and directives:
Batteries Regulation
Packaging and Packaging Waste Regulation
RoHS Directive
End-of-Life-Vehicles Directive
Providing opinions on requests for exemptions/derogations from restricted substances under the following directives:
RoHS Directive
End-of-Life-Vehicles Directive
Toys Safety Directive
Proposing limit values for POPs substances in waste streams at the request of the European Commission (EC).
“A legislative process for data regulation is ongoing”, Mr. Pollard stressed. The main process is developing and maintaining an EU-wide portal for chemicals, including data from other EU agencies. The secondary process is to develop repository of reference values and set up an EU data generation mechanism, an early warning system, etc.
